    Enriching Discourse on Public Domains

    Is there one public domain, or are there many public domains? The scholarly literature predominantly assumes there is only one, for references abound to “the public domain” in the singular. Yet, even a cursory review of this literature reveals that scholars sometimes define this term differently. So if there is only one public domain, but many definitions, perhaps one objective of scholarly discourse about the public domain should be to seek consensus on the one “true” definition.Professor James Boyle has provocatively suggested that there are many public domains, and has urged scholars to develop a rich vocabulary for distinguishing among them. He points out that the word “property” has multiple meanings, and discourse about property proceeds without confusion because legal professionals have learned to discern which meaning is intended from the textual context. Boyle urges intellectual property scholars to develop a similarly nuanced public domain vocabulary so that it will be possible to distinguish among its several meanings as well.This essay considers the potential benefits of accepting the existence of multiple public domains and ways in which discourse about public domains might be enriched thereby. Part II provides a synopsis of thirteen conceptions of the public domain found in the law review literature, explaining each, generally by reviewing the explication of it offered by its principal proponent or discoverer. Part III organizes the definitions by recognizing that they cluster around three main foci: 1) the legal status of information resources, 2) freedoms to use information resources, even if protected by IP rights, and 3) accessibility of information resources. Although it is common to think of information resources as either IP-protected or public domain, and as either publicly accessible or not, Part III shows that the public domain literature views these concepts not as binary opposites, but rather as points along a continuum. Part IV discusses the advantages and disadvantages of recognizing multiple public domains and recommends the use of adjectives to clarify discourse about the many public domains. The constitutional public domain, for instance, is distinct from the privatizable (although not yet, privatized) public domain. This Part differentiates among conceptions of public domains that should be accepted and those that perhaps should not. The principal advantage of recognizing multiple public domains is that it illuminates a range of important social values served by these domains and a plethora of strategies for preserving them and the values they serve

    Compressive Sensing has attracted a lot of attention over the last decade within the areas of applied mathematics, computer science and electrical engineering because of it suggesting that we can sample a signal under the limit that traditional sampling theory provides. By then using dierent recovery algorithms we are able to, theoretically, recover the complete original signal even though we have taken very few samples to begin with. It has been proven that these recovery algorithms work best on signals that are highly compressible, meaning that the signals can have a sparse representation where the majority of the signal elements are close to zero. In this thesis we implement some of these recovery algorithms and investigate how these perform practically on a real video signal consisting of 300 sequential image frames. The video signal will be under sampled, using compressive sensing, and then recovered using two types of strategies, - One where no time correlation between successive frames is assumed, using the classical greedy algorithm Orthogonal Matching Pursuit (OMP) and a more robust, modied OMP called Predictive Orthogonal Matching Pursuit (PrOMP). - One newly developed algorithm, Dynamic Iterative Pursuit (DIP), which assumes and utilizes time correlation between successive frames. We then performance evaluate and compare these two strategies using the Peak Signal to Noise Ratio (PSNR) as a metric. We also provide visual results. Based on investigation of the data in the video signal, using a simple model for the time correlation and transition probabilities between dierent signal coecients in time, the DIP algorithm showed good recovery performance. The main results showed that DIP performed better and better over time and outperformed the PrOMP up to a maximum of 6 dB gain at half of the original sampling rate but performed slightly below the PrOMP in a smaller part of the video sequence where the correlation in time between successive frames in the original video sequence suddenly became weaker.Compressive sensing har blivit mer och mer uppmarksammat under det senaste decenniet inom forskningsomraden sasom tillampad matematik, datavetenskap och elektroteknik. En stor anledning till detta ar att dess teori innebar att det blir mojligt att sampla en signal under gransen som traditionell samplingsteori innebar. Genom att sen anvanda olika aterskapningsalgoritmer ar det anda teoretiskt mojligt att aterskapa den ursprungliga signalen. Det har visats sig att dessaaterskapningsalgoritmer funkar bast pa signaler som ar mycket kompressiva, vilket innebar att dessa signaler kan representeras glest i nagon doman dar merparten av signalens koecienter ar nara 0 i varde. I denna uppsats implementeras vissa av dessaaterskapningsalgoritmer och vi undersoker sedan hur dessa presterar i praktiken pa en riktig videosignal bestaende av 300 sekventiella bilder. Videosignalen kommer att undersamplas med compressive sensing och sen aterskapas genom att anvanda 2 typer av strategier, - En dar ingen tidskorrelation mellan successiva bilder i videosignalen antas genom att anvanda klassiska algoritmer sasom Orthogonal Matching Pursuit (OMP) och en mer robust, modierad OMP : Predictive Orthogonal Matching Pursuit (PrOMP). - En nyligen utvecklad algoritm, Dynamic Iterative Pursuit (DIP), som antar och nyttjar en tidskorrelation mellan successiva bilder i videosignalen. Vi utvarderar och jamfor prestandan i dessa tva olika typer av strategier genom att anvanda Peak Signal to Noise Ratio (PSNR) som jamforelseparameter. Vi ger ocksa visuella resultat fran videosekvensen. Baserat pa undersokning av data i videosignalen visade det sig, genom att anvanda enkla modeller, bade for tidskorrelationen och sannolikhetsfunktioner for vilka koecienter som ar aktiva vid varje tidpunkt, att DIP algoritmen visade battre prestanda an de tva andra tidsoberoende algoritmerna under visa tidsekvenser. Framforallt de sekvenser dar videosignalen inneholl starkare korrelation i tid. Som mest presterade DIP upp till 6 dB battre an OMP och PrOMP

    Widespread adoption of uniform standards is essential to the smooth operation of our modern global economy. When private organizations develop such standards, copyright protection of those standards often creates a conflict between private intellectual property rights and society\u27s need for standards. This conflict is especially apparent when a local or state government adopts a privately drafted standard as law. This Article considers whether coding system standards should be eligible for copyright protection as a matter of U.S. copyright law by examining the case law\u27s treatment. of copyright protection for coding system standards and considering the policy concerns implicated by copyrights in standards. The Article concludes that, in light of case law, the statutory exclusion of systems from U.S. copyright protection, the scenes a faire and merger of idea and expression doctrines, and broader policy considerations, standards should fail outside the scope of U.S. copyright protection

    A Fresh Look at Tests for Nonliteral Copyright Infringement

    Determining whether a copyright has been infringed is often straightforward in cases involving verbatim copying or slavish imitation. But when there are no literal similarities between the works at issue, ruling on infringement claims becomes more difficult. The Second and Ninth Circuits have developed five similar yet distinct tests for judging nonliteral copyright infringement. This Essay argues that each of these tests is flawed and that courts have generally failed to provide clear guidance about which test to apply in which kinds of cases. This Essay offers seven specific strategies to improve the analysis of nonliteral infringements. Courts should do more, for instance, to tailor infringement analysis based on the nature of the works at issue (that is, are they fanciful or artistic works or are they factual or functional?). The goal of this Essay is to offer these strategies as a way to bring greater coherence and consistency to the determination of nonliteral infringements, and to do so in a manner that properly balances the interests of first and subsequent generations of creators
